A New Local League, Yes! LWV of the Ft. Wayne Area

In June, Indiana added its 19th local League of Women Voters of Ft. Wayne Area.


Indiana Voter ID Declared Constitutional by the Indiana Supreme Court

On June 30, 2010, the Indiana Supreme Court reached a 4-1 decision declaring the state's 2005 Voter ID law constitutional.  This action culminated a long sequence of events.  Following a 2009 Indiana Court of Appeals decision declaring the Indiana Voter ID law unconstitutional (because it violates the Equal Privileges and Immunities Clause of the Indiana Constitution, Article 1, Section 23; read the opinion here), the defendant, Todd Rokita, in his role as Secretary of State, petitioned to transfer the case to the Indiana Supreme Court.  On January 25, 2010, that court issued the Petition to Transfer, and scheduled oral arguments for March 4, 2010.  The Supreme Court decision, filed on June 30, 2010, revealed a four-to-one vote affirming “the judgment of the trial court granting the appellee’s motion to dismiss and rejecting the plaintiff’s claims that the Indiana Voter ID Law contravened Article 2, Section 2 or Article 1, Section 23 of the Indiana Constitution.”

Although the League did not win this case, the door is open for making future cases.  Justice Boehm's dissenting opinion held that, I think both precedent and the language of the Indiana Constitution dictate that the voter ID requirement is an unauthorized qualification for casting a ballot,” and, “I would remand this case to permit the plaintiffs to attempt to prove their case.”  (Read the complete Indiana Supreme court opinion here.)

    When I hear the phrase “the common good,” it inevitably takes my mind to League of Women Voters. In my experience, the League is the only non-faith organization that consistently looks beyond itself when creating positions on issues, striving to understand what would serve the common good.

    The common good does not take into account whether my friends or I will make money or lose money if a certain policy is enacted.

  • ID behind the ID

    On Sept. 17, 2009, the Indiana Court of Appeals ruled Indiana's Voter ID law invalid, yet regulations still will require voters to show a photo ID at the polls on Nov. 3. Indiana's voter ID must be issued by the federal or Indiana government and must display a photo, a name reasonably corresponding to that in the poll book, and an expiration date. Granted, since this is the “off year” for elections, fewer voters than usual will be affected by this requirement, but that is no reason to ignore the hurdles one must pass in order to obtain such a document.
